The supplier of the mixture must provide an SDS to the recipient of the mixture in the EU, in accordance with REACH Article 31.The importer, namely the natural or legal person established within the community who is responsible for import of the mixture, is the EU-based supplier if they supply the mixture further to any recipient in the EU. The importer is thus responsible for compiling an SDS compliant with Annex II and must be identified as the supplier of the SDS. The SDS should be based on information on the substances that the importer should obtain from the only representatives and the non-EU formulator.
