The toll formulator (or private labeller) is a duty holder under to Article 45 of the CLP Regulation. The toll formulator’s customer does not have any direct notification obligations if they only store and place the mixture on the market, meaning, they act as a distributor (i.e. they do not perform any activities as a downstream user, such as formulation, re-packaging, re-filling). However, they do have the following obligations under Article 4(10), if as a distributor, they re-label, re-brand or place on a market where their toll formulator supplier has not notified.
