Answer (EN)
Upon the submission of an inquiry under Article 26 REACH, as a potential registrant you will receive access to the Co-Registrants’ page in REACH-IT, where you can find information on the previous registrants of your same substance. Depending on the information provided by those previous registrants, you will find information on the name of the manufacturer, the importer or their representative, their address and other contact details. At that point, you may become aware that the previous registrant who submitted the data you need for registration purposes is subject to EU sanctions. This may include cases where the data was previously submitted by an only representative of a non-EU manufacturer subject to such measures. The sanctions in question may include a prohibition to make economic resources available to the sanctioned party, a prohibition to engage in a transaction with that party or a prohibition to provide certain services.Depending on the circumstances of each case, these prohibitions may prevent the conclusion of a data sharing agreement between you and the previous registrant. If that is the case, you may, as a last resort, submit a data sharing dispute with ECHA. Further details on data sharing are available at Data sharing - ECHA (europa.eu) and in the Guidance on data-sharing.Note that registrants may have appointed a third party representative to hide their own name from their co-registrants or submitted a request to hide the registrant’s name from the public. Only representatives of non-EU manufacturers may also have opted for the identity of their principal not to be disclosed to other co-registrants. Against this background, it remains a responsibility of each operator to carry out the necessary checks on the identity of the previous registrants as required by sanction compliance. For further details, see ECHA’s Q&A 1768 and Q&A 1896.For more information on the impact of sanctions on data sharing, please see the FAQs published by the European Commission at this link. See in particular FAQs 2, 3, 5, 8 and 15.
