No, the supplier of a nanoform does not always have to provide a SDS to the recipient. A SDS will be required only if the nanoform meets any of the conditions set out in Article 31 of the REACH Regulation.In particular, Article 31(1) provides that a SDS is needed whenever a substance meets the criteria for classification as hazardous according to the CLP Regulation, when it is PBT or vPvB, or when is part of the candidate list for the eventual inclusion in the authorisation regime pursuant to Article 59(1).Nanoforms of a substance may have toxicological profiles that are different from the non-nanoform of that substance. As a result, a nanoform may fulfil any of the conditions above even if the non-nanoform of the same substance does not. If a nanoform meets one or more of the above conditions but the non-nanoform does not, a SDS will be required for the nanoform but not for the non-nanoform. If neither the nanoforms nor the non-nanoform meet any of the conditions, no SDS will be required for either of them.
