Can a downstream user whose use is covered by an authorisation, store and place the authorised substance on the market to supply a downstream user who does not hold an authorisation for that use?

A downstream user can use an Annex XIV substance provided that the use is in accordance with the conditions of an authorisation granted to an actor up their supply chain for that specific use (Article 56(2)). Furthermore, a downstream user, importer or manufacturer is allowed to place a substance on the market for a use where an authorisation has been granted for that use (Article 56(1)(a)). Therefore, a downstream user, whose use is covered by an authorisation, can supply the substance to another downstream user (‘DU X’), who does not hold an authorisation for this use, for the same use as long as the substance is duly labelled (Article 65) and used by DU X in accordance with the conditions set out in the authorisation decision.
